Yalova&#8217;da ya\u015fanan ve yerel mahkemeden d\u00f6nen bir dava dosyas\u0131, Yarg\u0131tay Hukuk Genel Kurulu&#8217;nun \u00f6n\u00fcne geldi ve verilen karar, m\u00fclk sahiplerinin elini g\u00fc\u00e7lendirdi.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Olay Nas\u0131l Geli\u015fti?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Taraflar aras\u0131nda bir i\u015fyeri i\u00e7in kira s\u00f6zle\u015fmesi imzaland\u0131. S\u00f6zle\u015fmeye g\u00f6re kirac\u0131, sadece kira bedelini de\u011fil; elektrik, su ve ortak alan giderlerini de (yan giderler) m\u00fclk sahibine \u00f6deyecekti.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kirac\u0131, kira \u00f6demelerini aksat\u0131nca m\u00fclk sahibi icra takibi ba\u015flatt\u0131 ve kendisine 30 g\u00fcn s\u00fcre verildi. Kirac\u0131, bu 30 g\u00fcnl\u00fck s\u00fcre i\u00e7inde <strong>sadece kira borcunu<\/strong> (172.000 TL) \u00f6dedi ancak icra emrinde yer alan elektrik, su ve ortak gider bor\u00e7lar\u0131n\u0131 \u00f6demedi.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Yerel Mahkeme: &#8220;Kira \u00d6dendiyse Tahliye Olmaz&#8221; Dedi<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">M\u00fclk sahibi, yan giderlerin \u00f6denmemesi nedeniyle tahliye davas\u0131 a\u00e7t\u0131. Ancak Yerel Mahkeme ve ard\u0131ndan B\u00f6lge Adliye Mahkemesi (\u0130stinaf), kirac\u0131y\u0131 hakl\u0131 buldu. Mahkemeler, &#8220;Kirac\u0131 as\u0131l bor\u00e7 olan kiray\u0131 \u00f6dedi. Elektrik ve su paras\u0131 gibi yan giderler konusundaki anla\u015fmazl\u0131klar tahliye nedeni yap\u0131lamaz, bu konu ayr\u0131ca yarg\u0131lama gerektirir&#8221; diyerek tahliye talebini reddetti.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Yarg\u0131tay Hukuk Genel Kurulu&#8217;ndan &#8220;D\u00f6n\u00fcm Noktas\u0131&#8221; Karar<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Dosya temyiz edilerek Yarg\u0131tay&#8217;a ta\u015f\u0131nd\u0131. Yarg\u0131tay 12. Hukuk Dairesi yerel mahkemenin karar\u0131n\u0131 bozdu, ancak yerel mahkeme karar\u0131nda direndi. Son s\u00f6z\u00fc s\u00f6yleyen Yarg\u0131tay Hukuk Genel Kurulu (HGK), 02.07.2025 tarihli karar\u0131yla tart\u0131\u015fmay\u0131 bitirdi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">HGK, T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun (TBK) 315. maddesine at\u0131fta bulunarak \u015fu tespiti yapt\u0131:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><em>&#8220;Kirac\u0131, kira bedelini veya yan gideri \u00f6deme borcunu ifa etmezse&#8230; kiraya veren s\u00f6zle\u015fmeyi feshedebilir.&#8221;<\/em><\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">Karar\u0131n Gerek\u00e7esi ve Sonu\u00e7lar\u0131<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Yarg\u0131tay HGK, karar\u0131nda \u015fu kritik noktalara dikkat \u00e7ekti:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>\u0130tiraz Edilmemesi Borcu Kesinle\u015ftirir:<\/strong> Kirac\u0131, kendisine g\u00f6nderilen \u00f6deme emrine 7 g\u00fcn i\u00e7inde itiraz etmedi\u011fi i\u00e7in, hem kira borcunu hem de yan gider bor\u00e7lar\u0131n\u0131 kabul etmi\u015f say\u0131l\u0131r.<\/li>\n\n\n\n<li><strong>Yan Gider de Kira Gibidir:<\/strong> Kanuna g\u00f6re kirac\u0131n\u0131n temerr\u00fcde (direnime) d\u00fc\u015fmesi i\u00e7in sadece kiray\u0131 \u00f6dememesi gerekmez; s\u00f6zle\u015fmede kararla\u015ft\u0131r\u0131lan yan giderleri \u00f6dememesi de tahliye nedenidir.<\/li>\n\n\n\n<li><strong>Tahliye Zorunludur:<\/strong> Kirac\u0131 30 g\u00fcnl\u00fck yasal s\u00fcrede kiray\u0131 \u00f6deyip yan giderleri \u00f6demedi\u011fi i\u00e7in temerr\u00fct olu\u015fmu\u015ftur ve tahliye edilmelidir.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Bu Karar Ne Anlama Geliyor?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu karar, \u00f6zellikle i\u015fyeri kiralamalar\u0131nda ve aidat\/fatura \u00f6demelerinin m\u00fclk sahibi \u00fczerinden yap\u0131ld\u0131\u011f\u0131 konut kiralamalar\u0131nda dengeleri de\u011fi\u015ftirecek nitelikte.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Kirac\u0131lar \u0130\u00e7in Uyar\u0131:<\/strong> Hakk\u0131n\u0131zda bir icra takibi ba\u015flat\u0131ld\u0131\u011f\u0131nda, 30 g\u00fcnl\u00fck s\u00fcre i\u00e7inde sadece kiray\u0131 yat\u0131rmak sizi kurtarmayabilir. \u0130cra emrinde yer alan ve s\u00f6zle\u015fmeye dayanan aidat, elektrik, su gibi yan giderleri de \u00f6demezseniz tahliye edilebilirsiniz.<\/li>\n\n\n\n<li><strong>M\u00fclk Sahipleri \u0130\u00e7in G\u00fcvence:<\/strong> Kirac\u0131n\u0131z kiran\u0131 \u00f6d\u00fcyor ama apartman aidat\u0131n\u0131 veya s\u00f6zle\u015fmedeki di\u011fer masraflar\u0131 \u00f6demiyorsa, &#8220;Nas\u0131lsa kiray\u0131 al\u0131yorum, \u00e7\u0131karamam&#8221; diye d\u00fc\u015f\u00fcnmeyin. Hukuk Dairesince yap\u0131lan inceleme sonunda bozulmu\u015f, \u0130lk Derece Mahkemesi taraf\u0131ndan \u00d6zel Daire bozma karar\u0131na kar\u015f\u0131 direnilmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Direnme karar\u0131 alacakl\u0131 vekili taraf\u0131ndan temyiz edilmekle; kesinlik, s\u00fcre, temyiz \u015fart\u0131 ve di\u011fer usul eksiklikleri y\u00f6n\u00fcnden yap\u0131lan \u00f6n inceleme sonucunda, temyiz dilek\u00e7esinin kabul\u00fcne karar verildikten sonra Tetkik H\u00e2kimi taraf\u0131ndan haz\u0131rlanan g\u00fcndem ve dosyadaki belgeler incelenip gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>I. TALEP<\/strong><br>Alacakl\u0131 vekili; taraflar aras\u0131nda 01.09.2020 tarihinde imzalanan ve 01.01.2021 ba\u015flang\u0131\u00e7 tarihli kira s\u00f6zle\u015fmesi ile 10.03.2021 tarihinde imzalanan 01.09.2020 ba\u015flang\u0131\u00e7 tarihli ek kira s\u00f6zle\u015fmesi uyar\u0131nca bor\u00e7lunun mecuru i\u015fyeri olarak kullanmak \u00fczere kiralad\u0131\u011f\u0131n\u0131, \u015eubat\/2022 ve Haziran\/2022 d\u00f6nem aral\u0131\u011f\u0131na ait kiralar ve yan giderlerin \u00f6denmemesi nedeniyle Yalova \u0130cra M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn 2022\/7715 Esas say\u0131l\u0131 dosyas\u0131nda tahliye talepli il\u00e2ms\u0131z takip ba\u015flat\u0131ld\u0131\u011f\u0131n\u0131, tahliye talepli \u00f6deme emrinin 06.07.2022 tarihinde bor\u00e7luya tebli\u011f edildi\u011fini, bor\u00e7lunun tebli\u011fden itibaren otuz g\u00fcn i\u00e7inde t\u00fcm dosya borcunu \u00f6demesi gerekirken, 03.08.2022 tarihinde icra dosyas\u0131na &#8220;2022\/7715 esas &#8230; &#8230;, &#8230; borcuna istinaden&#8221; \u015feklindeki a\u00e7\u0131klamayla 172.000,00 TL \u00f6deme yapt\u0131\u011f\u0131n\u0131, takip talebi ve \u00f6deme emrinde kira bedelleri d\u0131\u015f\u0131nda yer alan t\u00fcm alacak kalemleri i\u00e7in dayanak olan kira s\u00f6zle\u015fmesinin 9.4 ve 9.5 maddelerinde elektrik-su ba\u011flant\u0131lar\u0131, ortak gider vs. kullan\u0131mdan do\u011fan alacaklar i\u00e7in &#8220;kira bedelleri d\u0131\u015f\u0131nda kalan di\u011fer t\u00fcm alacaklar\u0131n da \u00f6denmemesi durumlar\u0131 da kira gibi ayr\u0131ca tahliye nedeni&#8221; olarak say\u0131ld\u0131\u011f\u0131n\u0131 ileri s\u00fcrerek kira s\u00f6zle\u015fmesinin feshine ve kirac\u0131n\u0131n mecurdan tahliyesine, kiralanan\u0131n bo\u015f olarak teslimine karar verilmesini talep etmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>II. CEVAP<\/strong><br>Bor\u00e7lu vekili; takibe konu d\u00f6neme ili\u015fkin kira bor\u00e7lar\u0131n\u0131n \u00f6dendi\u011fini, takipteki di\u011fer alacak kalemleri konusunda taraflar aras\u0131nda mutabakat sa\u011flanmad\u0131\u011f\u0131n\u0131, bu nedenle tahliye talebinin kabul edilemeyece\u011fini belirterek istemin reddini savunmu\u015ftur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>III. \u0130LK DERECE MAHKEMES\u0130 KARARI<\/strong><br>\u0130lk Derece Mahkemesinin 12.10.2022 tarihli ve 2022\/469 Esas, 2022\/571 Karar say\u0131l\u0131 karar\u0131 ile; 2004 say\u0131l\u0131 \u0130cra ve \u0130flas Kanunu&#8217;nun (\u0130\u0130K) 269\/1 ve 269\/a maddeleri ile 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun (TBK) 315\/2. maddesi uyar\u0131nca yap\u0131lan incelemede \u00f6deme emrinin tebli\u011finden sonra otuz g\u00fcnl\u00fck temerr\u00fct s\u00fcresi i\u00e7erisinde 03.08.2022 tarihinde 172.000,00 TL&#8217;nin bor\u00e7lu taraf\u0131ndan takip dosyas\u0131na yat\u0131r\u0131ld\u0131\u011f\u0131, \u00f6deme emrinde talep edilen alacak kalemleri i\u00e7erisindeki kira alaca\u011f\u0131n\u0131n toplamda 172.000,00 TL oldu\u011fu, taraflar aras\u0131nda akdedilen yaz\u0131l\u0131 kira s\u00f6zle\u015fmesinin 9.4.6 maddesinde elektrik ve su bedellerinin \u00f6denmemesinin ayr\u0131ca fesih ve tahliye nedeni olaca\u011f\u0131 kararla\u015ft\u0131r\u0131lm\u0131\u015f ise de takipte talep edilen elektrik ve su giderlerinin miktar\u0131 konusunda taraflarca anla\u015fma sa\u011fland\u0131\u011f\u0131na dair herhangi bir bilgi ve belge bulunmad\u0131\u011f\u0131, bor\u00e7lu vekilinin cevap dilek\u00e7esinde kira alaca\u011f\u0131 konusunda taraflar aras\u0131nda ihtilaf bulunmamas\u0131 nedeniyle takipteki kira alaca\u011f\u0131n\u0131n \u00f6dendi\u011fi ancak elektrik ve su giderlerine ili\u015fkin olarak taraflar aras\u0131nda mutabakat sa\u011flanamad\u0131\u011f\u0131 \u015feklindeki beyan\u0131 kar\u015f\u0131s\u0131nda s\u00f6zle\u015fmede h\u00fck\u00fcm bulunsa dahi taraflar aras\u0131nda mutabakat sa\u011flanamayan yan giderlerin \u00f6denmemesinden dolay\u0131 bor\u00e7lunun tahliyesine karar verilemeyece\u011fi, bor\u00e7lu taraf\u0131ndan ihtar s\u00fcresi i\u00e7erisinde kira alaca\u011f\u0131 \u00f6dendi\u011finden temerr\u00fct \u015fart\u0131n\u0131n somut olayda ger\u00e7ekle\u015fmedi\u011fi gerek\u00e7esiyle istemin reddine karar verilmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>IV. \u0130ST\u0130NAF<\/strong><br><strong>A. \u0130stinaf Yoluna Ba\u015fvuranlar<\/strong><br>\u0130lk Derece Mahkemesinin yukar\u0131da belirtilen karar\u0131na kar\u015f\u0131 s\u00fcresi i\u00e7inde alacakl\u0131 vekili istinaf ba\u015fvurusunda bulunmu\u015ftur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>B. Gerek\u00e7e ve Sonu\u00e7<\/strong><br>B\u00f6lge Adliye Mahkemesinin 20.12.2023 tarihli ve 2023\/449 Esas, 2023\/2788 Karar say\u0131l\u0131 karar\u0131 ile; TBK&#8217;n\u0131n 313. maddesi uyar\u0131nca kirac\u0131n\u0131n kira bedelini \u00f6demekle y\u00fck\u00fcml\u00fc oldu\u011fu, kirac\u0131n\u0131n kira bedelini veya yan giderleri kira s\u00f6zle\u015fmesinde belirtilen tarihte ya da tarih aral\u0131\u011f\u0131nda eksiksiz olarak \u00f6demezse temerr\u00fcde d\u00fc\u015fece\u011fi, \u0130\u0130K&#8217;n\u0131n 269 ile 271. maddeleri aras\u0131nda adi kira ve has\u0131lat kiralar\u0131nda \u00f6demede temerr\u00fcde d\u00fc\u015f\u00fclmesi h\u00e2linde uygulanacak kurallar\u0131n d\u00fczenlendi\u011fi, somut olayda bor\u00e7lunun yedi g\u00fcnl\u00fck s\u00fcrede itiraz etmedi\u011fi ve il\u00e2ms\u0131z tahliye takibinin kesinle\u015fti\u011fi, otuz g\u00fcnl\u00fck \u00f6deme s\u00fcresini takip eden alt\u0131 ay i\u00e7inde de alacakl\u0131 vekilinin tahliye talep etti\u011fi, otuz g\u00fcnl\u00fck \u00f6deme s\u00fcresi i\u00e7erisinde 03.08.2022 tarihinde kira borcuna ili\u015fkin 172.000,00 TL \u00f6deme yap\u0131ld\u0131\u011f\u0131, kanuni d\u00fczenlemeler \u00e7er\u00e7evesinde daval\u0131n\u0131n sair iddialar\u0131n\u0131n ise dar yetkili icra mahkemesinde incelenemeyece\u011fi gerek\u00e7esiyle istinaf ba\u015fvurusunun esastan reddine karar verilmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>V. BOZMA VE BOZMADAN SONRAK\u0130 \u0130NCELEME S\u00dcREC\u0130<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A. Bozma Karar\u0131<\/strong><br>1. B\u00f6lge Adliye Mahkemesinin yukar\u0131da belirtilen karar\u0131na kar\u015f\u0131 s\u00fcresi i\u00e7inde alacakl\u0131 vekili temyiz isteminde bulunmu\u015ftur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2. Yarg\u0131tay 12. Hukuk Dairesinin yukar\u0131da tarih ve say\u0131s\u0131 belirtilen karar\u0131 ile;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;&#8230;2004 say\u0131l\u0131 \u0130cra \u0130flas Kanunu&#8217;nun kiralanan ta\u015f\u0131nmazlar\u0131n tahliyesine ili\u015fkin 269. maddesi gere\u011fince; &#8220;Takip adi kiralara veya has\u0131lat kiralar\u0131na m\u00fctedair olur ve alacakl\u0131 da talep ederse \u00f6deme emri, Bor\u00e7lar Kanunu&#8217;nun 260. ve 288. (6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 315. ve 362.) maddelerinde yaz\u0131l\u0131 ihtar\u0131 ve kanuni m\u00fcddet ge\u00e7tikten sonra icra mahkemesinden bor\u00e7lunun kiralanan \u015feyden \u00e7\u0131kar\u0131lmas\u0131 istenebilece\u011fi tebli\u011fini ihtiva eder.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu tebli\u011f \u00fczerine bor\u00e7lu, yedi g\u00fcn i\u00e7inde, itiraz sebeplerini 62&#8217;nci madde h\u00fck\u00fcmleri dahilinde icra dairesine bildirmeye mecburdur. Bor\u00e7lu itiraz\u0131nda, kira akdini ve varsa buna ait mukavelenamedeki imzas\u0131n\u0131 a\u00e7\u0131k ve kesin olarak reddetmezse, akdi kabul etmi\u015f say\u0131l\u0131r&#8230;&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunun 314. maddesi; &#8220;Kirac\u0131, aksine s\u00f6zle\u015fme ve yerel \u00e2det olmad\u0131k\u00e7a, kira bedelini ve gerekiyorsa yan giderleri, her ay\u0131n sonunda ve en ge\u00e7 kira s\u00fcresinin bitiminde \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr.&#8221; Ayn\u0131 kanunun 315. maddesi, &#8220;Kirac\u0131, kiralanan\u0131n tesliminden sonra muaccel olan kira bedelini veya yan gideri \u00f6deme borcunu ifa etmezse, kiraya veren kirac\u0131ya yaz\u0131l\u0131 olarak bir s\u00fcre verip, bu s\u00fcrede de ifa etmeme durumunda, s\u00f6zle\u015fmeyi feshedece\u011fini bildirebilir. Kirac\u0131ya verilecek s\u00fcre en az on g\u00fcn, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda ise en az otuz g\u00fcnd\u00fcr. Bu s\u00fcre, kirac\u0131ya yaz\u0131l\u0131 bildirimin yap\u0131ld\u0131\u011f\u0131 tarihi izleyen g\u00fcnden itibaren i\u015flemeye ba\u015flar.&#8221; h\u00fckm\u00fcn\u00fc i\u00e7ermektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Somut olayda, taraflar aras\u0131nda 01.09.2020 tarihli ve 01.01.2021 tarihinden itibaren 31.12.2022 tarihine kadar 2 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi konusunda uyu\u015fmazl\u0131k bulunmamaktad\u0131r. Kira s\u00f6zle\u015fmesinin 9.4.2 maddesinde &#8220;Elektrik ve su kullan\u0131m\u0131 i\u00e7in Kirac\u0131 taraf\u0131ndan \u00f6denecek bedel, kullan\u0131m ay\u0131na ili\u015fkin elektri\u011fin ve suyun ge\u00e7erli ticari tarifeden bedeli \u00fczerine %10 altyap\u0131 tesis maliyet pay\u0131 ilavesi esas al\u0131narak hesaplanacakt\u0131r.&#8221; 9.4.6. maddesinde; &#8220;Elektrik ve su bedellerinin \u00f6denmemesi durumu, kira bedellerinin \u00f6denmemesindeki gibi ayr\u0131ca fesih ve tahliye nedenidir.&#8221; d\u00fczenlemesi yer almaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130cra takibinin incelenmesinde; Yalova \u0130cra M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn 2022\/7715 E. say\u0131l\u0131 dosyas\u0131 ile toplam 171.336 ,00 TL kira alaca\u011f\u0131 yan\u0131nda, 24.882,80 TL ortak gider kat\u0131l\u0131m pay\u0131 alaca\u011f\u0131, 10.469,32 TL elektrik alt yap\u0131 servis ve hizmet bedeli alaca\u011f\u0131, 2.258,83 TL su kullan\u0131m bedeli alaca\u011f\u0131, 106.949,26 TL elektrik t\u00fcketim yans\u0131tma bedeli alaca\u011f\u0131n\u0131n tahsilinin talep edildi\u011fi, \u00f6rnek 13 \u00f6deme emrinin bor\u00e7luya 06.07.2022 tarihinde tebli\u011f edildi\u011fi, bor\u00e7lunun \u00f6deme emrine itiraz etmedi\u011fi, 30 g\u00fcnl\u00fck \u00f6deme s\u00fcresi i\u00e7inde 03.08.2022 tarihinde icra dosyas\u0131na 172.000,00 TL \u00f6deme yapt\u0131\u011f\u0131, TBK&#8217;n\u0131n 314 ve TBK&#8217;n\u0131n 315. maddesi gere\u011fince \u00f6demekle y\u00fck\u00fcml\u00fc oldu\u011fu yan giderleri \u00f6demedi\u011fi i\u00e7in temerr\u00fct olgusunun ger\u00e7ekle\u015fti\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O halde, \u0130lk Derece Mahkemesince tahliye isteminin kabul\u00fcne karar verilmesi gerekirken, yaz\u0131l\u0131 \u015fekilde h\u00fck\u00fcm tesisi isabetsiz olup B\u00f6lge Adliye Mahkemesi karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131 \u0130lk Derece Mahkemesi karar\u0131n\u0131n bozulmas\u0131 gerekmi\u015ftir &#8230;&#8221; gerek\u00e7esiyle karar oy \u00e7oklu\u011fuyla bozulmu\u015ftur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>B. \u0130lk Derece Mahkemesince Verilen Direnme Karar\u0131<\/strong><br>\u0130lk Derece Mahkemesinin yukar\u0131da tarih ve say\u0131s\u0131 belirtilen karar\u0131 ile; taraflar aras\u0131nda akdedilen ve ihtilaf konusu olmayan 01.09.2020 tarihli yaz\u0131l\u0131 s\u00f6zle\u015fmenin 9.4.2 maddesinde elektrik ve su kullan\u0131m\u0131 i\u00e7in kirac\u0131 taraf\u0131ndan \u00f6denecek bedelin kullan\u0131m ay\u0131na ili\u015fkin elektri\u011fin ve suyun ge\u00e7erli ticari tarifeden bedeli \u00fczerinden %10 altyap\u0131 tesis maliyet pay\u0131 ilavesi esas al\u0131narak hesaplanaca\u011f\u0131n\u0131n, 9.4.3 maddesinde kirac\u0131n\u0131n her ay\u0131n son g\u00fcn\u00fc yap\u0131lacak saya\u00e7 okumalar\u0131nda belirlenecek de\u011ferler \u00fczerinden 9.4.2. maddeye g\u00f6re bulunacak elektrik ve su kullan\u0131m bedellerinin kiraya veren taraf\u0131ndan d\u00fczenlenecek olan fatura kar\u015f\u0131l\u0131\u011f\u0131nda kiraya verene \u00f6deyece\u011finin, 9.4.6 maddesinde ise elektrik ve su bedellerinin \u00f6denmemesi durumunda kira bedellerinin \u00f6denmemesindeki gibi ayr\u0131ca fesih ve tahliye nedeni olaca\u011f\u0131n\u0131n d\u00fczenlendi\u011fi, alacakl\u0131n\u0131n takipte kira alaca\u011f\u0131 d\u0131\u015f\u0131nda ortak gider kat\u0131l\u0131m pay\u0131 alaca\u011f\u0131, su kullan\u0131m bedeli, elektrik alt yap\u0131 servis ve hizmet bedeli, elektrik t\u00fcketim yans\u0131tma bedeli alaca\u011f\u0131n\u0131 da talep etti\u011fi, TBK&#8217;n\u0131n 315. maddesinde yan giderlerin s\u00f6zle\u015fmenin feshi sebebi olaca\u011f\u0131na dair d\u00fczenleme getirilmi\u015f ise de \u0130\u0130K&#8217;n\u0131n 269\/a maddesinde a\u00e7\u0131k\u00e7a &#8220;kira borcunun&#8221; \u00f6denmemesi h\u00e2linde alacakl\u0131n\u0131n tahliye talep edebilece\u011finin d\u00fczenlendi\u011fi, kira borcu d\u0131\u015f\u0131ndaki yan giderlerin de tahliyeye konu edilebilece\u011fine dair kanun koyucunun istek ve arzusu olsayd\u0131 TBK&#8217;n\u0131n 315. maddesindeki gibi a\u00e7\u0131k bir d\u00fczenleme yap\u0131laca\u011f\u0131, yan giderlerin TBK&#8217;n\u0131n 315. madde kapsam\u0131nda tahliyeye konu edilip edilemeyece\u011finin ancak genel mahkemelerde tart\u0131\u015fma konusu olabilece\u011fi, s\u00f6zle\u015fmede h\u00fck\u00fcm bulunsa dahi taraflar aras\u0131nda mutabakat sa\u011flanamayan yan giderlerin \u00f6denmemesinden dolay\u0131 \u0130\u0130K&#8217;n\u0131n 269\/a madde kapsam\u0131nda tahliyeye karar verilemeyece\u011fi gerek\u00e7esiyle direnme karar\u0131 verilmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>VI. TEMY\u0130Z<\/strong><br><strong>A. Temyiz Yoluna Ba\u015fvuranlar<\/strong><br>\u0130lk Derece Mahkemesinin yukar\u0131da belirtilen direnme karar\u0131na kar\u015f\u0131 s\u00fcresi i\u00e7inde alacakl\u0131 vekili temyiz isteminde bulunmu\u015ftur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>B. Temyiz Sebepleri<\/strong><br>Alacakl\u0131 vekili; takip talebinde yer alan toplam kira bedelinin 172.000,00 de\u011fil 171.336,00 TL oldu\u011funu, bor\u00e7lu taraf\u0131ndan a\u00e7\u0131klamas\u0131z yap\u0131lm\u0131\u015f k\u0131smi \u00f6demenin TBK&#8217;n\u0131n 102. maddesi gere\u011fince sadece kira bedellerinin tahsiline y\u00f6nelik say\u0131lamayaca\u011f\u0131n\u0131, tahsil harc\u0131 kesintisi nedeniyle kira bedelinin eksik tahsil edildi\u011fini, bor\u00e7lu taraf\u0131ndan \u00f6deme emrine itiraz edilmedi\u011finden bor\u00e7lar\u0131n tamam\u0131n\u0131n kabul etmi\u015f say\u0131ld\u0131\u011f\u0131n\u0131, arada bir mutabakat olmad\u0131\u011f\u0131 gerek\u00e7esinin yerinde olmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrerek karar\u0131n bozulmas\u0131n\u0131 talep etmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>C. Uyu\u015fmazl\u0131k<\/strong><br>Direnme yoluyla Hukuk Genel Kurulu \u00f6n\u00fcne gelen uyu\u015fmazl\u0131k; tahliye talepli il\u00e2ms\u0131z icra takibinde kira alaca\u011f\u0131, ortak gider kat\u0131l\u0131m pay\u0131 alaca\u011f\u0131, elektrik alt yap\u0131 servis ve hizmet bedeli alaca\u011f\u0131, su kullan\u0131m bedeli alaca\u011f\u0131 ve elektrik t\u00fcketim yans\u0131tma bedeli alaca\u011f\u0131n\u0131n tahsilinin talep edildi\u011fi somut olayda kira alaca\u011f\u0131 d\u0131\u015f\u0131nda yan giderler \u00f6denmedi\u011fi i\u00e7in temerr\u00fct olgusunun ger\u00e7ekle\u015fip ger\u00e7ekle\u015fmedi\u011fi, buradan var\u0131lacak sonuca g\u00f6re tahliye isteminin kabul\u00fcn\u00fcn gerekip gerekmedi\u011fi noktas\u0131nda toplanmaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>D. Gerek\u00e7e<\/strong><br><strong>1. \u0130lgili Hukuk<\/strong><br>1. \u0130cra ve \u0130flas Kanunu&#8217;nun 269 ve 269\/a maddeleri.<br>2. 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 315. maddesi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. De\u011ferlendirme<\/strong><br>1. Uyu\u015fmazl\u0131\u011f\u0131n \u00e7\u00f6z\u00fcm\u00fc i\u00e7in konuya ili\u015fkin yasal d\u00fczenlemelerin irdelenmesinde yarar vard\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 314. maddesinde kirac\u0131n\u0131n aksine s\u00f6zle\u015fme ve yerel \u00e2det olmad\u0131k\u00e7a, kira bedelini ve gerekiyorsa yan giderleri \u00f6demekle y\u00fck\u00fcml\u00fc oldu\u011fu d\u00fczenlenmi\u015ftir. TBK&#8217;n\u0131n 315. maddesinde kirac\u0131n\u0131n sadece kira bedelini \u00f6demede temerr\u00fcde d\u00fc\u015fmesi de\u011fil, ayr\u0131ca yan giderleri \u00f6demede temerr\u00fcde d\u00fc\u015fmesi de bir fesih sebebi olarak \u00f6ng\u00f6r\u00fclm\u00fc\u015f, adi kira ve konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131nda kira bedelinin ve yan giderlerin \u00f6denmemesi h\u00e2linde akdin feshinin bi\u00e7im ve ko\u015fullar\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Buna g\u00f6re kiraya verenin kira s\u00f6zle\u015fmesini feshedebilmesi i\u00e7in \u00f6ncelikle kirac\u0131ya fesih ihtarnamesi g\u00f6ndermesi, muaccel olmu\u015f kira borcunu ve yan gideri \u00f6demesi i\u00e7in TBK&#8217;n\u0131n 315. maddesinde \u00f6ng\u00f6r\u00fclen s\u00fcrelerin verilmesi ve \u00f6deme yap\u0131lmad\u0131\u011f\u0131nda s\u00f6zle\u015fmenin feshedilece\u011finin ihtar edilmesi gerekir.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3. Kirac\u0131 verilen s\u00fcre i\u00e7inde kira borcunu ve yan gideri \u00f6demezse kiraya veren sulh hukuk mahkemesinde tahliye davas\u0131 a\u00e7abilir. Kirac\u0131n\u0131n s\u00f6zle\u015fme kapsam\u0131nda \u00f6demekle y\u00fck\u00fcml\u00fc oldu\u011fu kira bedelini ve yan giderleri tam ve zaman\u0131nda \u00f6dememesi durumunda \u00f6denmeyen veya eksik \u00f6denen kira bedelinin ve yan giderlerin tahsili ile kiralanandan tahliyesi i\u00e7in kiraya veren taraf\u0131ndan kirac\u0131 bor\u00e7luya kar\u015f\u0131 il\u00e2ms\u0131z icra takibi de yapabilir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4. \u0130cra ve \u0130flas Kanunu&#8217;nun 269-269\/d maddeleri aras\u0131nda kira bedelinin \u00f6denmemesi nedeniyle il\u00e2ms\u0131z tahliye takibi d\u00fczenlenmi\u015ftir. \u0130\u0130K&#8217;n\u0131n 269\/1. maddesine g\u00f6re kiraya veren \u00f6denmemi\u015f kiran\u0131n tahsili i\u00e7in yapt\u0131\u011f\u0131 il\u00e2ms\u0131z takip talebinde, kirac\u0131ya \u00f6deme emriyle TBK&#8217;n\u0131n 315. maddesinde yaz\u0131l\u0131 ihtar\u0131n da yap\u0131lmas\u0131n\u0131 isteyebilir. B\u00f6ylece kirac\u0131n\u0131n kira borcunu \u00f6demede gecikti\u011fi h\u00e2lde kiraya veren ayn\u0131 takipte hem \u00f6denmeyen kira bedellerini hem de bor\u00e7lunun temerr\u00fct nedeniyle tahliyesini talep edebilir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5. \u0130cra ve \u0130flas Kanunu&#8217;nun 269\/1. maddesine g\u00f6re kiraya veren alacakl\u0131 \u00f6deme emriyle TBK&#8217;n\u0131n 315. maddesinde yaz\u0131l\u0131 ihtar\u0131n yap\u0131lmas\u0131n\u0131 isteyebilece\u011finden, kiraya veren alacakl\u0131 takip talebinde kira bedelinin ve yan giderlerin (\u00f6demi\u015f ise) tahsilini talep edebilir (Baki Kuru, \u0130cra ve \u0130flas Hukuku El Kitab\u0131, Ankara, 2013, s.822; L. \u015eanal G\u00f6rg\u00fcn, Levent B\u00f6r\u00fc, Mehmet Kodako\u011flu, \u0130cra ve \u0130fl\u00e2s Hukuku, \u00dc\u00e7\u00fcnc\u00fc Bas\u0131, Ankara, 2022, s.363; \u0130brahim A\u015f\u0131k, Yakup Oru\u00e7, Ozan Tok, \u00d6mer Faruk Sa\u00e7ar, \u0130cra ve \u0130flas Hukuku, Ankara, 2022, s.378).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6. Alacakl\u0131n\u0131n (kiraya verenin) il\u00e2ms\u0131z tahliye takip talebini alan icra dairesi, bor\u00e7luya ihtarl\u0131 (\u00f6rnek 13 Nolu) \u00f6deme emri g\u00f6nderir. Bu \u00f6deme emrinde di\u011fer kay\u0131tlarla birlikte bor\u00e7lunun (kirac\u0131n\u0131n) kural olarak yedi g\u00fcn i\u00e7inde \u00f6deme emrine itiraz edebilece\u011fi, itiraz s\u00fcresi i\u00e7inde kira s\u00f6zle\u015fmesini ve varsa yaz\u0131l\u0131 kira s\u00f6zle\u015fmesindeki imzas\u0131n\u0131 a\u00e7\u0131k ve kesin olarak reddetmezse (ink\u00e2r etmezse) kira s\u00f6zle\u015fmesini kabul etmi\u015f say\u0131laca\u011f\u0131, kira borcunu \u00f6deme emrinin tebli\u011fi tarihinden itibaren TBK&#8217;n\u0131n 315. maddesinde belirtilen \u00f6deme s\u00fcresi i\u00e7inde \u00f6demesi, itiraz s\u00fcresi i\u00e7inde (\u0130\u0130K md. 62 ) \u00f6deme emrine itiraz etmez ve \u00f6deme s\u00fcresi i\u00e7inde borcu (kiray\u0131) \u00f6demez ise kiraya verenin (alacakl\u0131n\u0131n) kesinle\u015fen kira alaca\u011f\u0131 i\u00e7in haciz isteyebilece\u011fi (\u0130\u0130K md. 78 vd.) ve icra mahkemesinden (kirac\u0131n\u0131n) kiralanan ta\u015f\u0131nmazdan tahliyesini isteyebilece\u011fi ihtar edilir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7. Bor\u00e7lu itiraz s\u00fcresi i\u00e7inde \u00f6deme emrine itiraz etmez ise il\u00e2ms\u0131z tahliye takibi kesinle\u015fir. Bor\u00e7lu (kirac\u0131n\u0131n) s\u00fcresinde \u00f6deme emrine itiraz etmemesi ile il\u00e2ms\u0131z tahliye takibi kesinle\u015firse de, alacakl\u0131 (kiraya veren) bunun \u00fczerine hemen haciz ve tahliye isteyemez. Bor\u00e7lu \u00f6deme s\u00fcresi i\u00e7inde borcunu (kiray\u0131) \u00f6deyebilir. Bor\u00e7lu \u00f6deme emri tebli\u011finden itibaren \u00f6deme s\u00fcresi i\u00e7inde kira borcunu \u00f6derse il\u00e2ms\u0131z tahliye takibi son bulur, alacakl\u0131 haciz ve tahliye isteyemez (Kuru, s.828-829).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8. \u0130cra ve \u0130flas Kanunu&#8217;nun 269\/a maddesine g\u00f6re, bor\u00e7lu itiraz etmez ve kira borcunu da \u00f6demezse alacakl\u0131 \u00f6deme s\u00fcresinin bitim tarihini takip eden alt\u0131 ay i\u00e7inde icra mahkemesinden tahliye isteyebilir. Alacakl\u0131n\u0131n tahliye talebi \u00fczerine icra mahkemesi ilk \u00f6nce alacakl\u0131n\u0131n il\u00e2ms\u0131z tahliye takip talebinin kanuna uygun olup olmad\u0131\u011f\u0131n\u0131 inceler. Takip talebi kanuna uygun de\u011filse, \u00f6zellikle alacakl\u0131 takip talebinde tahliye istememi\u015fse, icra mahkemesi tahliye talebinin reddine karar verir. Bundan sonra icra mahkemesi bor\u00e7lu kirac\u0131ya g\u00f6nderilen \u00f6deme emrinin kanuna uygun olup olmad\u0131\u011f\u0131n\u0131 inceler. \u00d6deme emri kanuna uygun de\u011filse, \u00f6zellikle \u00f6deme emrinde \u00f6deme (ihtar) s\u00fcresi yanl\u0131\u015f (noksan) g\u00f6sterilmi\u015fse, \u00f6deme emrinde \u00f6deme (ihtar) s\u00fcresi yaz\u0131l\u0131 de\u011filse veya \u00f6deme emrinde tahliye ihtar\u0131 yok (tebli\u011f edilen \u00f6deme emri 13 \u00f6rnek Nolu \u00f6deme emri de\u011fil) ise, icra mahkemesi tahliye talebinin reddine karar verir. \u0130cra mahkemesi, takip talebinin ve \u00f6deme emrinin kanuna uygun oldu\u011funu tespit ederse, bunun \u00fczerine bor\u00e7lu kirac\u0131n\u0131n s\u00fcresi i\u00e7inde \u00f6deme emrine itiraz edip etmedi\u011fini ara\u015ft\u0131r\u0131r. Buna g\u00f6re, icra mahkemesi bor\u00e7lunun s\u00fcresinde \u00f6deme emrine itiraz etmedi\u011fini (veya itiraz etmemi\u015f say\u0131ld\u0131\u011f\u0131n\u0131) tespit ederse, bor\u00e7lunun \u00f6deme (ihtar) s\u00fcresi i\u00e7inde kira borcunu \u00f6deyip \u00f6demedi\u011fini inceler (Kuru, s.831, 833).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9. S\u00fcresi i\u00e7inde \u00f6deme emrine itiraz etmemi\u015f olan bor\u00e7lu, \u00f6deme (ihtar) s\u00fcresi i\u00e7inde kira borcunu tamamen \u00f6dememi\u015f ise ihtar m\u00fcddetinin bitim tarihini takip eden alt\u0131 ay i\u00e7inde alacakl\u0131 kiraya verenin talebi \u00fczerine icra mahkemesi, bor\u00e7lu kirac\u0131n\u0131n tahliyesine karar verir (\u0130\u0130K md. 269\/a).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>10. Somut olayda alacakl\u0131 kiraya veren taraf\u0131ndan bor\u00e7lu kirac\u0131 aleyhine tahliye talepli il\u00e2ms\u0131z icra takibi ba\u015flat\u0131lm\u0131\u015ft\u0131r. Takip talebinde kira alaca\u011f\u0131, ortak gider kat\u0131l\u0131m pay\u0131 alaca\u011f\u0131, elektrik alt yap\u0131 servis ve hizmet bedeli alaca\u011f\u0131, su kullan\u0131m bedeli alaca\u011f\u0131 ve elektrik t\u00fcketim yans\u0131tma bedeli alaca\u011f\u0131 olmak \u00fczere toplam 314.437,46 TL&#8217;nin tahsili talep edilmi\u015ftir. (\u00d6rnek 13 Nolu) \u00f6deme emri bor\u00e7luya tebli\u011f edilmi\u015f ve bor\u00e7lu yasal s\u00fcresinde takibe itiraz etmemi\u015ftir. Bor\u00e7lu otuz g\u00fcnl\u00fck temerr\u00fct s\u00fcresi i\u00e7inde icra dosyas\u0131na kira borcuna kar\u015f\u0131l\u0131k olarak 172.000,00 TL \u00f6deme yapm\u0131\u015ft\u0131r.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11. Takibe dayanak 01.09.2020 tarihli kira s\u00f6zle\u015fmesinin 9.4.2 maddesi &#8220;Elektrik ve su kullan\u0131m\u0131 i\u00e7in Kirac\u0131 taraf\u0131ndan \u00f6denecek bedel, kullan\u0131m ay\u0131na ili\u015fkin elektri\u011fin ve suyun ge\u00e7erli ticari tarifeden bedeli \u00fczerine %10 altyap\u0131 tesis maliyet pay\u0131 ilavesi esas al\u0131narak hesaplanacakt\u0131r.&#8221;, 9.4.3. maddesi &#8220;Kirac\u0131, her ay\u0131n son g\u00fcn\u00fc yap\u0131lacak saya\u00e7 okumalar\u0131nda belirlenecek de\u011ferler \u00fczerinden 9.4.2. maddeye g\u00f6re bulunacak elektik ve su kullan\u0131m bedellerini, kiraya Veren taraf\u0131ndan d\u00fczenlenecek fatura kar\u015f\u0131l\u0131\u011f\u0131nda Kiraya Veren&#8217;e \u00f6deyecektir.&#8221;, 9.4.6. maddesi; &#8220;Elektrik ve su bedellerinin \u00f6denmemesi durumu, kira bedellerinin \u00f6denmemesindeki gibi ayr\u0131ca fesih ve tahliye nedenidir.&#8221;, 9.5.1. maddesi &#8220;\u00dcnite&#8217;nin bulundu\u011fu mahallin genel g\u00fcvenli\u011fi, ayd\u0131nlat\u0131lmas\u0131, temizli\u011fi ve \u00e7\u00f6p toplama hizmeti gibi ortak giderlere kat\u0131l\u0131m pay\u0131, \u00dcnite&#8217;nin a\u00e7\u0131k ve kapal\u0131 alanlar\u0131n\u0131n toplam\u0131 \u00fczerinden m2 ba\u015f\u0131na ayl\u0131k 5,5 TL+KDV ile hesaplan\u0131r ve Kiraya Veren taraf\u0131ndan Kirac\u0131ca, \u00dcnite&#8217;nin Kirac\u0131ya tesliminden itibaren ayl\u0131k olarak fatura edilir. Belirtilen bu bedellerin \u00f6denmemesi durumu, kira bedellerinin \u00f6denmemesindeki gibi aynca fesih ve tahliye nedenidir.&#8221;, 9.5.2. maddesi &#8220;Kirac\u0131, Kiraya Veren&#8217;in ortak giderlere kat\u0131l\u0131m faturas\u0131n\u0131 en ge\u00e7 5 (be\u015f) g\u00fcn i\u00e7inde Kiraya Veren&#8217;e 5.4 maddede belirtilen banka hesab\u0131na havale ile defaten \u00f6deyecektir.&#8221; \u015feklindedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>12. Kiralanan \u00e7at\u0131l\u0131 i\u015f yeri olup, takibe dayanak kira s\u00f6zle\u015fmesinde elektrik ve su kullan\u0131m bedellerinin, ortak gider kat\u0131l\u0131m pay\u0131 alaca\u011f\u0131n\u0131n kirac\u0131 taraf\u0131ndan kiraya verene \u00f6denece\u011fi d\u00fczenlenmi\u015ftir. Bor\u00e7lu yasal s\u00fcresinde \u00f6deme emrine itiraz etmedi\u011finden yan gider borcu ve miktar\u0131 kesinle\u015fmi\u015ftir. TBK&#8217;n\u0131n 315. maddesi gere\u011fince kirac\u0131 taraf\u0131ndan kira bedelini veya yan giderleri ifada temerr\u00fcde d\u00fc\u015f\u00fclmesi h\u00e2linde kar\u015f\u0131la\u015f\u0131lacak olan hukuki sonu\u00e7 ayn\u0131d\u0131r. Bu durumda \u0130\u0130K&#8217;n\u0131n 269 ve TBK&#8217;n\u0131n 315. maddeleri gere\u011fince otuz g\u00fcnl\u00fck temerr\u00fct s\u00fcresi i\u00e7inde yan gider borcu \u00f6denmedi\u011fi i\u00e7in temerr\u00fct olgusunun ger\u00e7ekle\u015fti\u011finin kabul\u00fc zorunludur. O h\u00e2lde bor\u00e7lunun tahliyesine karar verilmesi gerekir.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">13. Hukuk Genel Kurulunda yap\u0131lan g\u00f6r\u00fc\u015fmeler s\u0131ras\u0131nda, \u0130\u0130K ve ilgili Y\u00f6netmelik h\u00fck\u00fcmlerinin kira alaca\u011f\u0131 ve kira borcu kavramlar\u0131ndan bahsetti\u011fi, lafzi yorum yap\u0131ld\u0131\u011f\u0131nda kira borcu kapsam\u0131na yan giderlerin (su, elektrik v.b.) dahil oldu\u011fu sonucuna var\u0131lamayaca\u011f\u0131, icra mahkemesinin g\u00f6rev alan\u0131na giren temerr\u00fct nedeniyle tahliye istemlerinin yasal dayana\u011f\u0131n\u0131n \u0130\u0130K&#8217;n\u0131n 269\/a maddesi olup yasa koyucunun bilin\u00e7li olarak &#8220;kira borcunu&#8230;.&#8221; ifadesini tercihle yetindi\u011fi, TBK&#8217;n\u0131n 315\/1. maddesindeki &#8220;&#8230; veya yan gideri&#8230;&#8221; tabirini \u00f6zellikle kullanmad\u0131\u011f\u0131, kira s\u00f6zle\u015fmesinde belirli bir edimin (giderin) kirac\u0131ya ait oldu\u011funun belirtilmi\u015f olmas\u0131n\u0131n o edimin (borcun) kira borcundan say\u0131lmas\u0131n\u0131 gerektirmedi\u011fi, kira alaca\u011f\u0131 d\u0131\u015f\u0131nda kalan alacaklar\u0131n ve kira alaca\u011f\u0131n\u0131n fer&#8217;\u00eelerinin \u00f6denmemesi temerr\u00fcde esas te\u015fkil etmeyece\u011finden icra mahkemesince tahliyeye karar verilemeyece\u011fi bu nedenle direnme karar\u0131n\u0131n onanmas\u0131 gerekti\u011fi g\u00f6r\u00fc\u015f\u00fc ileri s\u00fcr\u00fclm\u00fc\u015f ise de bu g\u00f6r\u00fc\u015f, yukar\u0131da a\u00e7\u0131klanan nedenlerle bu g\u00f6r\u00fc\u015f Kurul \u00c7o\u011funlu\u011funca benimsenmemi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">14. H\u00e2l b\u00f6yle olunca, Hukuk Genel Kurulunca da benimsenen \u00d6zel Daire bozma karar\u0131na uyulmas\u0131 gerekirken, \u00f6nceki kararda direnilmesi usul ve yasaya ayk\u0131r\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">15.
